In this week's Tax Rep Podcast I discuss why parents who lend money to their children should file a lien securing their interest.  Though most people will be offended by the topic - "But we trust little Johnnie!" - it has nothing to do with a lack of love or greed.  The lien from the friendly creditor may be what provides both protection against other creditors (includingt he IRS), and also allow the child to continue operating their business when most other creditors would move to shut them down.Check out the this week's Podcast and all the other Podcasts in ITunes here: TAX REP PODCASTIf you want to watch the video in YouTube it can be found here: TAX REP YOUTUBE CHANNELIf you are looking to join us inside Tax Rep LLC and start building your tax representation practice come check us o...

In this week's Tax Rep Podcast I discuss the IRS agreeing to extend its pilot program of the $100,000 Streamlined Installment Agreement ("SIA").For those of you unfamiliar with the SIA, it is an installment agreement where the taxpayer agrees to repay the IRS overtime.  But unlike a regular agreement, an SIA allows the taxpayer to just agree to the repayment number with the IRS without providing any documentation: no Form 433, no documentation on assets and income, and no attorneys fees! The SIA was capped so that those who owe $50,000 or less and could afford to pay it over 72 months or less were eligible.  Last speing the IRS rolled out a pilot program extending the SIA to those taxpayers who owed less than $100,000 and could full-pay over 84 months.  Trust me when I tell you, it was a...

In this week's Tax Rep Network's podcast I discuss how to get rid of a federal tax lien.Check out the Podcast Here:When it comes to federal tax liens, the IRS takes a very hard line.  The IRS will not remove a tax lien just because it is causing issues for the taxpayer, including credit score or other economic harm.  The reason for this is that all of its research tells the IRS that the tax lien gets the tax debt paid.So what can be done about it?In the podcast I review options for obtaining a lien subordination, discharging assets from the tax lien, and the option for having the tax lien withdrawn.Any questions about IRS issues, contact me at (203) 285-8545 or by email at egreen@gs-lawfirm.com.Also, check out Tax Rep at www.taxrepllc.com. Eric L. In this week's Tax Rep Network's podcast I discuss why the IRS examiner is going to obtain the electronic back-up of the Quickbooks file and what practitioners can do about it.Check out the Podcast Here:IRS examiners will insist on obtaining the electronic back-up so they can review the Quickbooks Audit trail and hone-in on items that may give them insight as to what the taxpayer was up to or what issues may exists in the taxpayer's records.  I review the issues and those moves the practitioner should always do before handing over the file to prepare for what is coming next.Any questions about IRS issues, contact me at (203) 285-8545 or by email at egreen@gs-lawfirm.com.  Also, check out Tax Rep at www.taxrepllc.com. Eric L. GIven that the focus of my practice is civil and criminal tax repressentation, tax liens are something we deal with frequently.  The refrain "I would love to sell my house but there is a tax lien" is one we hear so much it makes me nuts. The reality is this: you can absolutely sell the house.  The IRS will be more than happy to allow the house to be sold.  The only thing the IRS requires is that the seller who owes money to the government not walk away with money that the IRS should have received. So if the taxpayer owes money to the IRS, say $100,000.  They also own a home worth $400,000.  I will explain exactly what the IRS will get in each of the following circumstances: Taxpayer sells and owes the bank $100,000.  In this case the IRS will get full-paid.  The house will sell for $400,0...

Based on the feedback of the blog article I posted a little while ago, I have recorded a podcast walking you through why it is critical to consider filing the State tax returns first, then filing the federal returns.  As I mentioned in the Blog Post HERE, filing the state tax returns first can both help resolve the state issue and make resolving the federal tax issue that much easier.Check out the podcast here at Tax Rep in Itunes: https://itunes.apple.com/us/podcast/podcasts-tax-rep-llc/id1276903945

When it comes to tax crimes in New Haven, Connecticut, New York city or elsewhere, Tax Evasion is always considered the big kahuna of tax crimes.  So what is "Tax Evasion"?We handle civil IRS cases and criminal tax cases all over the United States, and therefore see a lot of what taxpayers do and don't do that later get them into trouble.  One thing I do notice is the confusion about what "Tax Evasion" actually is, and that most practitioners do not realize there are two forms of tax evasion: Evasion of Liability and Evasion of Collection.  More and more, the Evasion of Collection is being used to go after taxpayers, particularly when the government has noted that the taxpayer is structuring cash deposits.  Structuring is one of those crimes that many people commit without even realizin...

The focus of our practice is on civil and criminal tax controiversies in Connecticut and New York City.  An individual’s petition to invalidate four Notices of Federal Tax Liens filed against him was dismissed for failure to state a claim on which relief could be granted. He petitioned the court to invalidate the liens based on a number of tax-protestor-type arguments including, inter alia, that there was no authority for filing the Notices against him under the Administrative Procedures Act, that no Executive Orders existed to establish internal revenue districts for the collection and enforcement of income taxes, the regulations used by the IRS for its assessment authority and its method of assessment were unenforceable because they aren’t published in the Federal Register, and the au...
