Escrow, Your "Neutral Third Party," Beware!In California, an escrow is a usual course of events for the sale of a home. Escrow is created when a written agreement between parties instructs a “neutral third party” to hold funds and only proceed when all the agreed conditions have been performed. It is the escrow instructions that advise the escrow officer how to complete the transaction. This means that an escrow officer is only to act upon written instruction.
