Does My Loan Modification Open me up to a Deficiency Judgment in California? California is a non-Deficiency Judgment state on Purchase Money Loans foreclosed under a Trustee Sale. In short if you purchased a home with a $500,000.00 loan and never refinanced; then the home is foreclosed on and fetches $300,000.00 at the Trustee Sale. There is a $200,000.00 Deficiency. The bank cannot pursue you for this difference. The Home Alone Stands For the Loan. A Short Sale may be the Best Solution – Go here for Short Sale Info! The State of California has expanded this some to include 2nd mortgages. However, the question has been asked, “If a buyer does a Modification of the original purchase loan is it still a non-Recourse (non-Deficiency) Loan?” My initial reaction is that it is still a non-Reco...

Buying a Home – 10 Things to Know when Make an Offer #8 – Service Providers When Preparing an Offer on a Home you will have to select some service providers in the offer. Post 8 will talk about those Service Providers. Number 8 – Service Providers. When Purchasing a Home in California you will need to designate a Title and Escrow Company. In this area they are often the same company but they can be different companies. Title Insurance protects you from unknown liens or problems with the Title. Escrow handles the transaction and makes sure all monies and documents are handled appropriately. In California the Buyer chooses Title and Escrow, by custom in this area the Buyer also pays these fees (It varies by area). However, some banks and institutional Sellers will pay some Title and Escro...

Buying a Home – 10 Things to Know when Make an Offer #7 – Expenses When Making an Offer on a Home there will be a division of expenses between the Home Buyer and Home Seller. In the 7th post we will cover Expenses. Number 7 – Expenses. When Buying a Home there are Expenses that need to be attributed to one party or the other in the contract. These can be Title & Escrow Cost, Transfer Taxes, Home Warranties, and even different inspections; although in this market generally speaking buyers pay for the inspections. An Expense is different from the credits we covered earlier. Credits are used to pay things that the Home Buyer is responsible for, whereas Expenses define who is responsible. It may seem like a minor difference but it is not. If the Seller pays Title and/or Escrow it does not c...

Buying a Home – 10 Things to Know when Make an Offer #6 – Contingencies When Making an Offer on a Home the Contingencies define obligations under the contract and time frames that the escrow should move forward. In our 6th post I will cover Contingencies. Number 6 – Contingencies. When Buying a Home you will define in Preparing Your Home Purchase offer that time frame for Loan Approval, Inspections, Appraisals, and the Seller Delivery of Documentation. These time frames are called Contingencies. Most contracts have default Contingencies in the contract, but can be altered. An example is a contract might allow a Home Buyer 17 days to complete the inspection on a property and sign off (Waive) the inspections. Or you if you run into problems ask for a modification of the contract or an ext...

Buying a Home – 10 Things to Know when Make an Offer #1 - Closing Date I help people make lots of offers when they are Buying a Home. Often times when people find the home they want they just look at me and tell me to make an offer at a certain price. But there is so much more that goes into making an offer. In this series of post I am going to cover 10 Things You Need to Consider when Making an Offer on a Home: Number 1 – Closing Date. When Preparing an Offer on a Home you need to provide a closing date or a closing time line. On the standard California Real Estate Forms you need to either put a Closing Date or a Time Frame, like 30 Days, 45 Days etc. This is an important consideration and you have to balance two competing factors – The Seller generally wants to close ASAP and so a Sho...

Brentwood Ca Homes for Sale – May 2012 Housing Supply Brentwood Homes are in a Strong Sellers market. The absorption rate is close to 100% and over 100%. In other words we are selling almost as many homes every month as come onto the market. Home Sales in Brentwood On 5/17/2012 there were 90 Homes for Sale in Brentwood. There are 335 Pending Homes. Total Home Sales in April were 80, very close to 100%. The large number of Pending homes is due to quick sales and the large number of Short Sales that take a long time to close. What is a normal Brentwood Real Estate Market? A balanced market 4 to 6 times as many homes on the market as there are sales each month. With this many sales we should have about 320 to 480 homes on the market to consider it a balanced market. So How do I Buy a Brent...

Writing Offers that get Accepted! Lately the market is going crazy. There are 20 or more offers on some homes, many well over asking price. So how does a Buyer get an offer accepted. There seems to be two approaches: The first approach is to keep writing offers that are very reasoned, with a price based on sold comps. Sometimes asking for closing cost credits and maybe 30 days to close. Many people will submit dozens of offers like this; and in this market they will all be rejected. These are not offers that anyone will take seriously. In this market at the time of this post to get an offer accepted you need to submit it almost as soon as the home comes on the market – don't take too much time to think about it – that is what a contingency period is for. The price needs to be at asking ...

How do you view the value of a Home? Right now we are in a market that is going up fast – the current appraisal situation is freezing out many buyers that due to their loan situation cannot afford to pay more than it will appraise for. Due to the new appraisal rules appraisers are having trouble with a market going up. You cannot value something up if nothing has sold higher before; yet in an up market that is exactly what homes cost. In fact values are taking off like a Rocket right now. So if you really want to buy a home you need to consider how you value a home, not what it will appraise for. Now I don't suggest you get crazy and pay more than you have to. If a similar house is selling for less and it is just as good to you – buy it! But the you need to figure out what a home is wor...

What to look for when Buying a Two Story Home in Brentwood Right of the Bat I am going to say that Two Story Homes tend to be cheaper per SF. That is why there are so many of them compared to single story homes. Especially in newer or larger construction. Now I have found people that prefer two story homes over a single story, but most do not. A lot don't care What Should I look for in a Two Story Home? Things that will help you avoid using the stairs. What are those things, Downstairs Master Suites, or a downstairs bedroom. With many multi-generaltional families the downstairs bedroom is becoming more important. Often times homes around here will have a “Den” downstairs that can be converted to a bedroom, but make sure you have a full bath downstairs To avoid hauling laundry up and dow...
