California has enough disclosures as it is. As mentioned, Sellers are required to complete the Transfer Disclosure Statement (TDS) and it is prudent also to complete the SPQ.  

The C.L.U.E. Report I believe only covers a limited number of years.

We have had C.L.U.E. reports in CA for decades which essentially do that for the seller, but they are also required to disclose these things on their TDS and SPQ disclosures.

Yes, it became law October 1, 2024. I have already sent to one of my sellers and it is an attachment in the MLS. With the current hurricane (Milton) coming our way, I am not sure if it will need to be updated.

Our AZ SPDS requires seller to disclose if there has been water damage. Also required in our RPC is an insurance claims history. There are instructions to buyer to obtain insurance asap for themselves and not rely on seller's prior insurability.
My folks bought a house here, and had a huge cluster during the transaction bc their house in CA had TWO WATER CLAIMS in 3 years. That made getting insurance SO COST PROHIBITIVE . . . their insurance company simply raised their rates. So these things do come out in the wash, LOL

I'm actually surprised FL just changed their statute, I would have thought it to be material long ago . . .

Buyers have a right to know and it should be disclosed. Thomas J. Nelson, REALTOR ® CRS,ABR,PSA,RCS-D, ePRO mentioned C.LU.E. reports and they have been around forever. I venture to say a majority of licensed agents are unaware.

In CA we've had that for years,but it is not required to be disclosed before offer, it is on our transfer disclosure statement.

Haven't seen that here in the Carolinas even though the coasts are always in danger of flood damage. I suspect that people buying in those areas are savvy enough to ask for a history of the properties.

This is probably a good thing. I recall when we sold our first home in FL around 1996, we had to disclose if we had received insurance money for hail damage. We had unusual hail storms that year. Most buyers would confirm the repairs were done or ask for the money so they could do the repairs.

Interesting. I have not seen anything yet as the only major weather concern is flooding from Monsoon Season. In AZ, we do have a required Seller's Property Disclosure Statement and that could be added to that document.

I can see needing a disclosure for a flooded home, and whether it is repaired or not is important, however do not see how a claim with FEMA makes any additional difference.

Have not seen anything similar in Connecticut. We had a recent severe flood in a small area that was unprecedented, but generally the topography offers some elevation and safety? Ha, that's what they thought in the North Carolina hills. Nothing is sacred anymore. Flood zones need to be disclosed in my state.

I don't know if we do or not Peter Mohylsky, Beach Broker but I think it is a good idea. I saw a lot of shoddy work done on homes that were flooded in our area. Fly by night contractors sheet rocked right over moldy wall and so on.  Families with allergy issues have a right to know.
