This has no bearing on the Realtor code of ethics. It's unethical in the real world, and my guess is that he'll pay-the-price by having to be with the "wife".

I think that might be considered a violation of Article 1, because it is not protecting and promoting the interest of their client.  It may also be a violation of Article 8 for not keeping client's money in a separate escrow account.
