I had clients years ago that purchased the land behind their home that once had a railroad line behind it.  When they were offered the option they jumped on it. 

Not sure of the terms you mention yet whatever they called it - sure seems similar to me.

Probably a useless lawsuit, once the govt takes something they seldom give it back, and this one was "taken" a very long time ago.

I had not heard of this, but not surprising. But do the adjacent landowners have any rights to this abandoned rail line? If they don't own it, the current owners should be able to do whatever they want with it as long it fits within current zoning regulations.

Never heard of this but easements and condemnation have been political isues for years. Many yeara ago I represented a building owner that a city had notified it was taking the land for the city benefit. We worked out a price since the city condemned many parcels. Once completed, a privately held casino was built on the properties. Government officials had a sudden increase of wealth for the public benefit. True representation. And, Hunter was not born yet!

I have not heard about this and it definitely is not fair.  I remember many years ago that a lot of the land at my Grandpa's farm was taken by the utility company, I think and it didn't seem fair at all nor did they do anything at all with the land.
