I put them on the MLS when the listing goes live, as a Buyers agent I find it annoying to have to call or email the listing agent for them when showing a property.

I put them on the MLS for everyone to see right away. It helps me have the information out there and prevents me from having to get them to cooperating agents for offers. We have to check whether the disclosures were received before/during the offer, or else we have to supply them within 3 days. Keeps me from having to get them out after an offer is agreed upon.

I put them in the documents section on MLS. The more information buyers have before they make an offer, the more solid the offer.

And I love when other listing agents have them right in MLS.

Our Team's procedure is to prepare a package with all disclosures that we have...seller disclosures, agent disclosures, inspections, and much more...and make it available through a link on the mls. We also put that link into the mls comments.

Having this information and the proper forms up front saves lots of questions and lots of time.

The system that we use also enables us to track how many and who has downloaded the package.

Best to include them on the mls, otherwise the buyers have a few days after receiving them to change their mind.

In the good old days, we didn't post to MLS. It was a good way to track and find out who was more interested in the property.

Today we post the SD, but still hold back the Survey for same reason!!! LOL

Depends. I ask them to start filling them out IMMEDIATELY so I CAN attach them . . . if they are not lickety split then it becomes more urgent once we get offers . . . general rule is ALL due diligence items attached to MLS for the agents. I will add them to Loopnet as well . . . the more you know the more comfortable buying and CLOSING.

I put it in attachments section of MLS. That information is available only to members of MLS. They can download as/when they need without bothering me to keep sending. In general, we don't wait for a contract to send out disclosures. Buyers review and sign disclosures and submit them with their offers.

Our office's procedure is to not do the disclosures until we are under contract.  Anything of significant importance, such as a major material defect or death within the alloted disclosure window, would be discovered during the listing and disclosed in the MLS agent remarks.  The handful of mandated disclosures however are not done until escrow as the two main ones are in relation to the condition of various aspects of the house and it is possible, especially in a normal market, for those conditions to change during the course of the listing (like a dishwasher breaking). 

 

For the agents that do them at the listing, what procedures do you have in place to insure accuracy of the disclosures?  What happens if a significant material defect occurs?  Do you have a directive to the seller to notify you immediately?  Do you have a policy and procedure to pull the documents immediately until they can be updated or an amendment can be made?  It may not be a concern in this "it sells in a day" market, but what about in a 3-6 month normal market?

Our MLS requires them right there next to the picture of the home and we have to have it all on within 48 hours of listing date unless the seller puts it in writing to put it active on a different date.

Up here, there is not a lawyer worth their weight that would advise a Seller to provide disclosures.  It's just not something that is done ie crucial for Buyer to have inspections.  (Also, inspections are not an opportunity to renegotiate )   Up here, we place more onus on the Buyers due diligence and almost all properties are sold As is, Where is

It depends, usually send them after under contract, but sometimes buyers want to see them beforehand.
