As the customer, it is best to find a good match to work with on jobs, especially jobs that will take a long time to finish. I think it's up to any home owner to make whatever rules they wish regarding contractors. It's also up to any contractor to take or not take a job.
I wouldn't mind contractors at my home using music/radio. I would only mind the cigarettes if someone tried to light up inside the house. Outside is fine. Although I might bring something outside they could use as an ashtray.

Smoke when you take a break. Listen to music on break or at lunch. When working, work! No cellphones or distractions! Also, demand pictures before, during and after whihc puts everything to rest. Be flexible and remember the rule: Contracts are only as good as the people behind them. Keep in mind too that simple tradesman have their way of producing results let them while they are there. Every south of the border crew I witnessed building and maintaining America were hard workers, timely, courteous and impecable in policing their workspace.
I would not begrudge these workers doing thankless and extremely difficult work a little music.

I have seen clauses similar used in exclusive golf course communities in Florida. They were pretty effective but sometimes hard to enforce. It worked where I was working because of the general contractors.

Hissy fitter #1 threw 3 fits demanding to be paid gas money: publicly at Home Depot, privately in kitchen, on driveway for the neighbors. His GF's email with f word 15xs claimed her hissy fitter ran out of gas on the road.
Hissy fitter #2 also participated in harassment scenes in yard and Home Depot, where my gift card was discovered stolen. Store manager replaced card within 24 business hours. I dealt with him directly. He emailed he could not identify non-employee harassers poking cells in my direction as cashier and asst mgr insisted they couldn't do anything.
Cyberstalkers in your home - goals are the same if history is best predictor of future performance. One goal of several: attempt to incite target to act out so complaint can be filed, police called and eventually declare target unstable and commit them. Then "legal" docs strangely emerge granting property ownership to persons unknown to owner. Historically (20 yrs) this is mainly perpetrated on single women. You get the scam.
These stalkers must have been so disappointed. The only scene they could create was their own bad behavior destroying their contractor reputation. They gave themselves away. Hissy fitter #2 very carefully questioned if I would recognize the perp who stole the gift card. "Yes, easily recognize him," and you as accessory. The same hissy fitter told me he could "read minds and knew what I really thought." I can write a book about dumb psychopathic cyber stalkers! Lesson learned: fire their asses a lot sooner.

When someone works on my house, I only want them to be happy so they do a perfect job and don't intentionally screw something up.
Decades ago, I owned a home service business where there were usually workers around so I saw some unsavory things that were done to picky owners...
Like concrete being flushed down the toilet and fiberglass rubbed inside a ladies bra that was on the bed.
I speak with workers to see if they need anything and we always pay the day they are finished...
