Technically it cannot transfer until the buyer becomes the legal title holder - owner of the property.  I do have the seller get confirmation, in writing, from the company that the warranty is, in fact, transferable AND I get the steps one needs to take to have the warranty transferred after the transaction closes.

I request a letter from the roofer prior to closing that transfers the warranty to the buyer.

After closing is too late for the seller to want to get involved and the buyer does not have any standing to ask for anything.

I would think that the warranty switches hands upon recording of the new deed thus showing ownership.

Most of our transferrable warranties are required to be done by the seller. The sellers provide the effective date and the new owners' information, also providing copies of all transfer documents. 

On occasion, the buyer has to manage that and for those, we just have the sellers provide a written statement from the company to that effect.

*  Suggestion:   Be careful what you write in the MLS or any advertising, or say to potential Buyers.  If you say, "Roof warranty will transfer to Buyer" and it doesn't, then YOU could be held liable.

Generally, I instruct the buyer to register themselves with the roofing company. But once there was a fee to transfer. Guess who got stuck paying that fee?

Yes! Usually transferable warranties are part of the contract. The seller gets confirmation and supplies the buyer with the transfer process

Our contract says it is at the buyers expense. So per the contract it falls on the buyer to initiate the transfer and pay for it. But in my experience the manufacturer's warranty does not convey beyond the original owner.

We have dealt with this recently and the warranty required the seller to take care of this.  However, different warranties may have different verbiage.  My answer would be determined by the verbiage of the warranty and who I am represesnting in the transaction.
