Generally, unless specifically excluded, subsurface rights transfer with ownership.  This isn't usually an issue "in town" but can be on large land parcels in some areas.  We have an abandoned gold and silver mine here in Central Washington.  It was mined out over about 9 years and closed.  Here is a link to the history of the Cannon mine in Wenatchee, Washington.

         Water is a public resource in Florida; we are floating in it, so that's no big deal.   But the potential for oil/fracking is a new thing... some Florida developers are reserving subsurface rights in the deeds.  Use a title attorney, get title insurance!

Every transaction in NC requires subsurface rights Disclosures be provided by the Sellers. Subsurface transfers with the property unless previous (or current) sellers reserved those rights, which must be noted on the separate Disclosure.

It's covered in our disclosures and recently a past client got to drill a well when the county first said they couldn't because of transfering subsurface rights.

Sometimes there are gravel mines and we do have lava tubes.  Once while excavating for their foundation, a contractor hit a lava tube.  The owner of the home was thrilled and kept access there with a stair down from their home.  It is a perfect wine storage area.

Subsurface rights don't typically come up in areas like N. Virginia they are more likely in areas with heavy mineral deposits. Typically unless a DEED states otherwise surface subsurface and air rights all transfer with the sale of a property

Real estate is loca and locally, for us, subsurface rights don't come up.
