I tell them they are welcome to continue to use our website, as it is a great resource. I let them know I will not bug them and I can not interfere with their relationship with another agent but ask permission to occassionally check in with them to make sure the website is working for them and the search is set up how they want it. Then I make a note in our system and I leave them be except for that occasional check in. We have even had people tell us their agent sent them to use our website because it is a good search site and we have had agents themselves use it. I know of one licensed agent currently that logs on almost daily and they have access to the MLS! We have had many occassions where the buyer decided to quit working with their agent or their agent leaves the business and then they work with us. We had one occassion that I specifically know of where the buyers were on our site for several years and by the time they were finally ready to relocate they said their agent (who they liked and had planned to use) had moved and was no longer licensed or local. They used us because we kept in touch but didn't interfere. Also sometimes people say they are working with an agent when they are not and they just say that for fear that they will be bothered. We often ask who the agent is. If they tell us and we know them we compliment them on their choice of agent and tell them we are sure their agent will do a great job for them, and best wishes but feel free to continue to use our website. If they pause, cannot remember their agents name or pronounce it incorrectly that is generally a clue they are not really working with anybody or tied to a specific agent.-Kasey

I love this question!  This kind of thing happens often when you are offering value to prospects.  Like Kasey, I often have agents refer their clients to my YouTube channel to get information.  Often, once they have reviewed what I have to offer, they make the choice to go straight to the source.

I will typically use the situation you describe to explain agency to the prospect and give them some alternatives to get the help they need.

Regardless, emailing costs me nothing, so I never delete anyone that signs up.

I let them know they are welcome to keep using my site as long and as much as they like. I've had people who told me they were working with another agent and really weren't, but didn't want me to "bother" them. And when they were ready they would reach out to me free and clear of any agents. I've also had buyers from out of state who technically were working with an agent on selling their home, but didn't have one here. At the end of the day, it's no real impact on my time to let the system drip them.

I would ask if they have a buyer broker contract signed. If not, it is free game...they cant be very happy if they are signing up on another agents website. However, I would be careful for this to not happen to me on the flipside. (Buyer speaking to other agents while I am working with him/her)

I just observe that person. Sometime they tell they have someone they work with just to get some privacy and when they are ready, they call you.

Might ask why they registered if they are working with someone else? Periodically check to see how they are doing. You never know when they might want different representation

I never required registration.  I don't like having to register on websites and I assume others don't either.  They did have the option to opt-in to listing notifications and to contact me direct.  

In your scenario, though, I'd just say I'm glad they found my website informative and feel free to come back anytime as it is constantly updated.

I would say:  "So how is that working out for you?" Then he would open up. 

I would also say: "Oh, so you are working with another agent. Are you in a buyer brokerage contract with your agent?" 

If he says now, which 90% of the time, agents don't have the buyer sign those, I would ask him how its going, what can I do for him, etc. 

The buyer is not really working with another agent if they are not in a contract to do so. It is also not against ethics, to solicit any buyer or seller that is not under contract.
