If there is no agreement on ANY issue, there is a difficulty.

Creating an agency relationship with an agent who has no clue what it is. 

  None, if you play by the rules.

Reading some court cases can provide some answers.

Same as the ones that arise in marriages, partnerships and working relationships.

There are no difficulties if the relationship is properly disclosed.

Agency is a legal term referring to the relationship and the fiduciary duties owned by the agent to the client. When those are not delivered then there are problems. When the client isn't committed to the relationship then there are problems as well.

This is a question that has been asked and answered more times than I can count since the start of the new year. I suggest you take a look at past responses and maybe do some additional research and then write a post about the subject. You'll learn so much more.

When the parties do not act in accordance with the agency role they are in with either the buyer or the seller

Many - lack of communication, lack of honesty, lack of follow through (these 3 can go both ways with agents and clients), lack of good representation, failure to think of the needs of the clients over the needs of the agent...the list goes on and on.

Misunderstandings.  That is why it is essential to go over what agency is in detail with a consumer, customer, potential client upfront.  And states do things very differently and have different agency laws, so someone coming from another state may think they understand agency when in reality it could be an entirely different dynamic.   Communication and understanding on both sides is key. -Kasey
