Consumers need to be more concerned with purchasing a quality product/making a decent investment for which we are paid fairly as a rule. My state doesn't ban it, but I do. I don't get in your pocket, stay out of mine. Excellent information!

No, but I don't think commission rebates are a good idea anyway - at least not a "rebate"

I can't understand a state's rationale for interfering with a business decision a Realtor makes on how much to charge.

Lise,
We have refused to do that, regardless of what the state says. A

That's good to know! I wish CA was one of them. Would eliminate a few companies from our market. Sadly, CA is so screwed up they'd probably make it a requirement as opposed to banning it!

I wish Florida would ban rebates...it might just improve the quality of the realtors.
Just think...how nice it would be that the agent would have to sharpen their skills in order to compete...now they just offer up half their paycheck.
I have never paid a consumer a rebate in order to get their business...hate the thought.

I've always been surprised that Maryland doesn't ban rebates to consumers. By the way, that's a good thing.

Disclosure in Florida is required but legal!

We don't have this restriction, but have never given a rebate back to a client.

I don't like the government telling me what I must earn and what I can do with my earnings. If I want or need to give a rebate, that should be my choice and only my choice. This country was based on compentsion and that should not change

Not in CA. Rebates here are thriving. I had few sellers who went with 0.5% listing agents. Good luck.

Lise Howe - I do not think MA is included in this - we still have Redfin and ZipRealty here.
5,409,954
Ours is not one that bans them (Redfin is here) and as others have said, it would be nice if they were banned in all states. QUALITY should be what the DOJ wants for buyers - not 'cheap' agents! (Sorry, that's probably not PC but, that's how I feel, Lise Howe!)

I think it makes our Profession look cheap.
I have seen some agents do this and they don't last long

I know Tennessee is one of those and remembr when they made it official.

No.
US state level law does not apply to Canadian real estate regulatory matters.

We don't have rebates in CT, but you can share with your principals, as I understand it, e.g. to facilitate a transaction.

Hi Lise - I know we don't ban them in Colorado, and we have used them on occasion, but not as an across the board marketing tool.

I knew about CA - no ban. Interesting to see the other states that ban them

I know Florida allows them. I wonder what would be a good reason for a state to ban them.

Oregon is one. Commissions can only go to Licensed real estate professionals.

Ten states currently have laws that ban rebates. Nine states have a full ban on broker rebates:Alabama, Alaska, Kansas, Louisiana, Mississippi, Missouri, Oklahoma, Oregon, andTennessee. In addition, Iowa prohibits rebates when the consumers use the services of two or more real estate brokers during a transaction.

Lise Howe,
Thanks for posting the questions, I was viewing this morning a reverse prospecting company that offers buyers rebates. My state is not ban:)

Not here, there are tons of realtors in DFW and many compete for clients by giving them rebates etc. Thank you for including the link.

When the homeowner agrees to the compensation shown on the listing agreement, they have NO intention of any portion of their dollars to go directly into the hand of the buyer.
Buyer agents who are not transparent in such rebate arrangements at the offer stage seem to create a situation incompatible with those who embrace ethics.

Mine is not one of them, and I offer both a nice Military Rebate & School Teacher Program because of it.
