Elizabeth Murphree For insurance and liability reasons, the sellers cannot allow you to move in prior to the closing.

The seller sattorney is not going to let that happen. That's what hotels are for.

Point out the benefits of a vacation with maid service at the local hotel as opposed to the stress and mess of living in a home that is not theirs yet surrounded by unpacked boxes and clutter.

Ask them if they see a "Relax, it's Holiday Inn" sign lit up over the door?
Perhaps they left the light on?
Are they Feeling the Hyatt touch?

What is the sellers situation? Perhaps they would entertain a buyers temporary lease.

It's not up to them. It's the sellers decision, and it's best if sellers don't allow it. There are plenty of hotels, motels, air bnb, etc places where they can stay for a few days.

There are no keys handed over until the transaction is closed. In our competitive market, often the seller and buyer have negotiated a holdover that possession to the new owner doesn't even take place then.

I would like to borrow their car for a week. I promise not to damage it and will pay them when I get back. It's all about liability, liability, liability now!

Ask them if they would want someone to move into their home before they got the money? This has all kinds of trouble written all over it!

the only reason they need is "they don't own the house"....

There is too much liability if the buyer moves in early, if the loan doesn't close.

Cute dog in the picture!
If the house is occupied, the sellers may not be able to get out in time for that.
My favorite one that I've used is: "If for some reason the loan can't be done at the last second and you can't close escrow, do you really want the seller having access and control over all your stuff?"
1,157,841
Presumably, the contract does not allow them access prior to closing. Perhaps you can refer them to a hotel.

Have no fear... You won't need a creative answer. The attorneys will simply tell them "no". Have some hotel suggestions & nearby restaurants ready for them & encourage them to enjoy this respite before moving day. ;)

They don't own the house. Three weeks ago, five days before closing, the buyer for my listing, lost his job and the financing was pulled.
Our landlord tenant laws would have protect the Buyer...

Absolutely NO. They don't own the house yet and so many things can go wrong!

How about "Because you are not the legal owner of the house."
I had buyers in this situation. Closing was delayed weeks because of the incompetence of the buyer's loan officer and the "professional" manager of the HOA. My buyers, a couple with a toddler, had given notice on their apartment, and this being Silicon Valley, the landlord had already rented it to someone else, so they couldn't stay longer.
They wanted to move in before closing too. Of course the answer was no. Then they wanted to see if they could just move furniture into the gargage. Of course that answer was no also.
They could have just stayed in their appartment as a holdover tenant, and dealt with an unlawful detainer that would have been taken off calendar, but they chose not to go that route.
They ended up staying in a hotel for three weeks.
Bottom line: You don't own the house so you can't move into the house. And of course, given Murphy's Law, if they had, something probably would have gone really wrong, and would have been very expensive to fix.
Have you asked them to look into Air BnB? Some clients did that and it was cheaper than a hotel.

Does the seller want to allow this? Has the seller checked into what his insurance company might have to say? I recently had this come up, but didn't have to deal with my buyer on it, because the seller said...NO!
3,986,423
So said the sellers.
Aslo, the law suit they will face if they don't close for any rreason and we have seen this often
3,644,234
Not going to happen on my watch. What does the contract say? The liablilty is high if sellers allow buyers to move in before closing.

Elizabeth,
Can you say, Double MOVING COST? You and I know things go wrong. You have to educate the buyer that if it does not close their butts will have to move out. It can get really ugly as well as legal cost.
I would put it to them this way, this is you speaking, " Mr/Mrs Buyers, I would feel terrible if for any reason you were not able to close of no fault of your own so moving in is NOT an option."

Love it. The closing got moved so they are down here local and have no where to go. Yes, it is their fault but cold weather makes it rough. The financial picture needs to remain stable til Monday.Thank you.
