Wow . . . if I were the seller, I would be wanting that deal to be pretty darn solid before I put out paying tenants. This is why I'm a terrible landlord - it's hard to mandate 'how people live'. But if your contract provides for seller to convey the building vacant . . . I guess they will find a way. I would certainly have a great cleaning crew at the ready as a resource for the buyer . . .

It is often difficult when a property is for sale and the tenants have no incentive to keep the unit clean and attractive to potential buyers.  The best solution is eviction and clean-up prior to listing.  Or, giving the tenant a financial incentive to move right away.  It can be money well spent, which would otherwise be lost in market time and price reductions.

I have a good relationship with the local law enforcement agency.  The renters also get a hand delivered notice that any damage would result in criminal action

I don't like to take listings with tenant's.  They're usually (not always) a pain.  If one gives me grief when I'm trying to show the home I call the listing Realtor and let them know.  Working through a rough transaction now due to a mad tenant that doesn't want to move.

Good morning Jack. Depending on where you are, it may take some time to vacate the property. If I was in that situation and wanted to make sure the transaction was moving forward. I would meet with the tenant and pay them to leave.

Be sure the escrow period is sufficent to cover extra time that may be required to clear the property. Handle everything by the book, whatever the rules are in your area. Here the gold standard is written notification best proved by a signed receipt. On day 30 if the tenant has not vacated post a notice of eviction (in my area that adds 4 days maximum). I've had good results with incentives for tenants like the seller offering $500 if they are out at least a week prior to closing.

Thankfully I don't have to do this. Although the company I work for has a property management department and one person manages over 80 rental units. I've heard the stories and seen the nightmares that get left behind.

We had this happen recently, except they were tenants over one year, so they got a 60-day notice per California law.  We needed the tenants gone sooner, so I told the seller that paying some money if they move out by a certain date will usually work.  A little money can go a long way.

However, that property was in an area that was not crazy expensive and with a very low vacancy rate like just about everywhere in the San Francisco bay area.  It is very difficult for someone to move early if they have no where to move to.

Very carefully! Just be thankful no eviction is needed since they are MTM and only need 30 days notice to vacate. When tenants know a unit is for sale, they will deliberately make it look as bad as possible to dfiscourage buyers and will make showings difficult for you. Been there, done that...
