1. A broker at my oh(I am also the owner) handing out cards to my visitors. I made face at her. She did not get it. I said go ahead you handed them to my visitors already. After returning home I found my photos were copied on her listing, She probably has been this way and owns a small brokerage. I had MLS remove stole photos from her listinf for the exterior.
2. You think this is bad. My wife was a listing agent and she overheard a buyer saying I can save you money. You fire that female agent to save you and us money.

I would go to the agent's broker and bring this to their attention so this practice is stopped immediately. An agent who does things "unethically" damages their reputation quickly ... and in the real estate market -- you don't want that reputation. It's difficult to gain respect back once you have soiled yourself. I would work very diligently and help my client find another property and move on.

It's rare that buyers I am working work go out on their own because of discussions we have about this sort of issue. I had an agent at an open house and one at a showing try to give their business card to my clients!

Yes, and this agent had a reputation for stealing clients. I called the offending agent and told her I had documented my agency relationship with my clients as well as their report to me of her repeated soliticitation after they informed her they were already represented. I informed her that I reported her behavior to my broker who would be reporting it to her broker. I told her I had prepared a file on theoffense and was ready to testify if my broker or other agents I knew she had offended decided to bring her up for Board review.
She talked tough but I never heard of another incident like that involving her. Her business dwindled and she is virtually inactive now. And I really do have that file just in case she tries to steal again. ;-)

In Tennessee agency isn't created verbally or by actions but only with a written agreement. This helps clarify for all parties and even helps the buyer know they have agreed to be represented. Other agents are to back off.

My buyers are very carefully “educated” in advance not to go to open houses with me. I let them know that they may owe an agent a commission if they do, a multi thousand dollar mistake to walk into a house they probably shouldn’t buy.

Oh, yeah! I even wrote about it last June. It wasn't at an open house but was similar in that seller got buyer's cell phone number (by design) and started texting her and trying to go behind my back. That one worked out okay in the end. There was another occasion where my buyers who only spoke spanish met the rental agent who was also fluent in spanish and became sympatico. Agent handed them her card in front of me. I had to raise hell for that one to work out but it did. I have no good advice except to sleep with one eye open.

This question has truly brought out the ire, some indignation, and some very excellent responses from the awesome agents who discuss these things here. Thank you my friends and colleagues - this is a lovely thing indeed!
Since there are a few repeating themes - rather than reply to each and every one individually - as I have (gratefully) an escrow to close on another property with these same clients - Tomorrow!!! - I'd like to add a few notes to my original question, and reply to many of the common threads of thought here - just my views - and thank you so much for yours!!!:
1. Open houses - A number of agents have said that they would never let their clients go alone .... Different markets will have different market realities - but in every market there is something in common that I'd like to address - We guide our clients - we, hopefully, lead them and encourage them to make good decisions. We don't, however own, control or dictate to them. To assume, or believe that we do - or should - is to disrespect their intelligence, individualities and freedom. I've read numerous posts from consumers, in response to agents saying things like: "I don't let my clients...." etc., and the response is never positive. Sometimes we need to put the shoe on the other foot, and imagine how we might feel if someone spoke about us in such ways - telling others what they do or do not "allow" us to do. We give information - we teach - we lead. It is up to the client to follow or reject that advice. I feel that this might be part of the core rejection that many consumers feel towards the industry as a whole. We're their helpers, not their boss.
2. Thank you everyone who has mentioned buyer broker agreements - They help - the idea of them helps. The activity of having a document, a process to sit down with a client and have a conversation with them about the perks and benefits of loyalty - not only to you - but also, how they win in the process.... whether or not a buyer signs the agreement - having had the conversation and expressing your desire that they honor the spirit of that arrangement 9 out of 10 times fixes the problem of loyalty. Most people are fair, and when they understand the equation, they will act as such. The others cannot be saved, helped or salvaged - and their reaction should be our signal to leave the relationship. Thank you very much.
3. Again - thank you so much - everyone for adding your voices and raising awareness about this ongoing problem. If we work together - as we're doing here - we can improve the process and professionalism in our industry.

Wow that is over the top. Required text for access ploy to get your buyers number and then double team them with a lender. I wonder if this strategy was hatched over cocktails. I think the danger of bad behavior is always out there and it can come from any direction. Things like this used to bother me quite a bit. Back to your question; I would call the agent and follow that up with a stop and desist email and copy in the lender and my supervising broker. If that fails to correct the problem then I would follow up with my broker for advice. Possibly submit an ethics violation to the local board.
PS: I always try to be with my buyers on visits to open houses & new subdivisions models.

I am just appalled and disgusted at the unprofessionalism of some agents. Fortunately this hasnt happened to me but I did have a client who after I met with him and explained how I work and agreed to work with me, ended up making an offer on a property with his "friend" in the business. You can't win them all.
I try to go to all Opens with my clients whenever possible or if I can't, I call the agent holding a property open to let them know that my clients will be stopping by.

Here we have to have a Consumer's Guide to Agency Disclosure signed by clients (either Seller or Buyer), by the second correspondence or before any financial/proprietary information is divulged. So I seriously doubt this agent had anything like that signed, so there would be an offense. Obviously, they told her they had representation, and there appears to be another offense.
It seems tough to not file complaints against this agent for these actions.
I just had someone, after 4 years, moving back from TX. She had me helping her all that time to then call someone online to buy a home. She told me the person contacted her, and my (ex)friend told me she informed the agent she was respresented, but the agent said no she didn't, and as things progressed, I believe my (ex)friend was lying to me about most of the correspondence she had with the other agent.
I'm glad you didn't lose out on things like I did. It hurt & still does a few months later.
